Terms of Service

These terms explain how you may use the Kinstart website and the general basis on which we provide our services. The detailed terms of any paid engagement are set out in a separate written agreement.

Last updated: 24 June 2026

1. Acceptance of These Terms

By accessing or using the Kinstart website, you agree to these Terms of Service. If you do not agree, please do not use the website. These terms apply to all visitors. If you engage us for paid services, the specific terms of that work will be set out in a separate written agreement or proposal, which takes precedence over these terms where they conflict.

2. The Website Is for General Information

Content on this website, including blog articles, service descriptions, and the free risk assessment, is provided for general information only. It does not constitute professional, legal, security, or compliance advice, and it does not create a client relationship. You should not act on it without obtaining advice specific to your situation.

3. Our Services

Kinstart provides IT consulting, cybersecurity, web development, and agentic AI integration services, which may include:

  • Cybersecurity consulting, assessments, and implementation support
  • Web development and design
  • AI agent design, customization, business system integration, and team enablement
  • IT strategy and consulting
  • Ongoing support and maintenance, where agreed

The exact scope, deliverables, fees, timelines, and any service levels for a given engagement are defined in the written agreement for that engagement, not on this website.

4. Free Cybersecurity Risk Assessment

The free cybersecurity risk assessment is intended as a general self assessment tool. It does not replace a professional security audit, penetration test, legal compliance review, or incident response service. Results are based only on the answers you provide and are a point in time, high level view. You are responsible for deciding how to act on the output.

5. No Guarantee of Security Outcomes

Security is never absolute. We work to recognised practices, but:

  • No system, assessment, or service can make you "100% secure" or prevent every breach or cyber attack.
  • Assessments and tests reflect the state of systems at the time of evaluation and may not identify every issue or future vulnerability.
  • Security effectiveness can depend on third parties and on your own implementation of recommendations.
  • We do not provide emergency or incident response services unless this is expressly included in a written agreement with you.

6. Acceptable Use

When using this website, you agree not to:

  • Use it for any unlawful, harmful, or fraudulent purpose.
  • Attempt to gain unauthorised access to, scan, probe, or disrupt the website or its infrastructure.
  • Submit false, abusive, or malicious content through our forms, or use them to send spam.
  • Copy, scrape, or reuse our content beyond what is permitted by law or by us in writing.
  • Infringe the rights of others or interfere with anyone else's use of the website.

7. Your Responsibilities

If you contact us or engage our services, you are responsible for:

  • Providing accurate and lawful information.
  • Maintaining your own backups and business continuity arrangements.
  • Deciding whether and how to implement any recommendations we provide.
  • Complying with the laws and regulations that apply to your organisation.

8. Intellectual Property

The Kinstart name, logo, website design, and content are owned by us or our licensors and are protected by applicable laws. You may view and share our content for personal or internal business reference, but you may not reproduce or reuse it commercially without our permission. For paid work, ownership of any custom deliverables is governed by the written agreement for that engagement; our existing tools, methods, and templates remain ours.

9. Third Party Services and Links

Our website and services may rely on or link to third party platforms (for example, hosting, form delivery, content delivery networks, messaging apps, and cloud providers). We do not control these third parties and are not responsible for their availability, content, or practices. Their use is subject to their own terms and policies.

10. Data Protection and Privacy

We handle personal data as described in our Privacy Policy, which forms part of these terms. Where we process personal data on behalf of a client as part of an engagement, the relevant data protection terms are set out in the applicable written agreement.

11. Disclaimers and Warranties

We provide our services with reasonable professional care and skill. To the extent permitted by law, the website and any free tools are provided "as is" and "as available," without warranties of any kind, including fitness for a particular purpose. We do not warrant that the website will be uninterrupted, free of errors, or free of harmful components. Any warranties for paid work are those set out in the applicable written agreement.

12. Limitation of Liability

Nothing in these terms limits liability that cannot be limited by law (such as for death or personal injury caused by negligence, or for fraud). Subject to that, and to the extent permitted by law:

  • We are not liable for indirect, incidental, special, or consequential loss, or for lost profits, revenue, data, or business opportunities arising from your use of the website or free tools.
  • For paid engagements, our liability is governed by, and limited as set out in, the relevant written agreement.

13. Confidentiality

Where we receive confidential information from you, we will use reasonable measures to keep it confidential and use it only for the purpose for which it was shared, except where disclosure is required by law. Detailed confidentiality terms for an engagement are set out in the relevant agreement.

14. Changes to the Website and These Terms

We may update, suspend, or discontinue parts of the website at any time. We may also update these terms from time to time; when we do, we will revise the "Last updated" date above and post the new version here. Continuing to use the website after changes take effect means you accept the updated terms.

15. Governing Law and Disputes

These terms are governed by the laws of Estonia, where we are based, and the courts of Estonia will have jurisdiction over any dispute, unless mandatory consumer law gives you other rights. We encourage you to contact us first so we can try to resolve any concern through good faith discussion.
